Santa Clara County Retains KBL to Sue GSK for Deceptive Marketing of its Drug Avandia
KBL has filed an advertising suit on behalf of the County of Santa Clara, for the benefit of all of the People of the State of California against GlaxoSmithKline ["Glaxo"] for its violation of California Business and Professions Code section 17500, et seq., for false advertising of the diabetes drug Avandia as being safe and effective.  The basis of the lawsuit is Glaxo's decade-long aggressive marketing strategy, combined with its concealing evidence regarding the increased cardiovascular risks associated with Avandia, resulting in billions of dollars of profits for Glaxo and an estimated 60,000 to 200,000 excess heart attacks, strokes, and other cardiovascular deaths in Avandia users between 1999 and 2006.  GSK had a duty to warn its patients and the FDA about the serious health risks associated with Avandia but chose to conceal that information in yet another example of a corporation putting its profits ahead of the safety of its customers.

     



 Way Paved for Distribution of Settlement Funds in E*Trade Privacy Rights Class Action

The Court of Appeal has now paved the way for distribution of the settlement funds to the E*Trade Privacy Rights Class. Distribution to all class members was put on hold when two objectors appealed the trial court’s order granting final approval of the settlement. Those appeals have now been resolved, leaving the trial court’s order fully intact. This means class members will soon find settlement checks arriving in their mail.

Dirty, stale air filled their lungs as soon as they entered the facility. Through the darkness, they could make out the forms of 18 African teenaged boys, who were perplexed by the sudden presence of a half-dozen white men, wearing suits and holding cameras.

This was an unusual sight at this remand home, a detention center for Ugandan minors who had been accused of crimes and were waiting for their cases to be heard in court.

Nearby, three teenaged girls were locked in a smaller concrete building. These 21 children had lived there, some for up to two years, sleeping on mats made of reeds and trying to survive with limited food and water.
